Pool Liability in Portugal: Accidents, Insurance and Holiday Rentals

The pool sits behind the house in Almancil, tiled all around, without a fence because it looks better that way. In summer the grandchildren are there, in spring friends stay for two weeks, and in winter the pool service comes once a week while nobody else is around. The neighbouring plot runs along the back, children play there, and between the two properties is a low wall with a gap on the slope.

This is not unusual in the Algarve. What is unusual is how rarely anyone checks in advance who pays if something happens. The answer is not found in a special private-pool regulation, because Portugal does not currently have a nationwide one for private pools. It is found in the Código Civil, and for the owner it is less comfortable than many expect: under Artigo 493.º, the injured person does not have to prove every element of your fault. You may have to prove that you did not fail in your duty of care.

The second point is an insurance-language trap that catches many foreign homeowners. A policy may say it includes personal liability, but that does not automatically mean an accident involving the pool at your Portuguese property falls under that section. For this guide, we reviewed two Portuguese home-insurance wordings and found that pool-related liability can sit under a different part of the contract. Damage to the pool itself, such as machinery, cover or frost damage to the structure, is a separate property-insurance issue under House Insurance in Portugal. This guide is about liability towards guests, neighbours and people working at the property.

The key points at a glance

  • The burden of proof can fall on you. Artigo 493.º n.º 1 of the Código Civil makes the person who has the thing under their control liable for damage it causes unless they prove that no fault existed on their part.
  • Private use and rental are two different worlds. Both policy wordings reviewed exclude damage arising from professional, commercial or profit-making activity at the insured property. Registered short-term letting falls into that category.
  • Short-term letting has its own compulsory liability insurance. Artigo 13.º-A of Decreto-Lei 128/2014 requires at least €75,000 per claim, and the registration can be cancelled if valid evidence is not provided.
  • The liability sections reviewed are not automatically included. In one product they are optional covers; in the other they appear as separate condições especiais that must be expressly identified in the condições particulares.
  • Generali has a specific pool-liability section, Fidelidade does not. Under Fidelidade, the pool forms part of the building and liability is handled through the insured-property liability section; Generali offers Responsabilidade Civil Piscinas with its own exclusions.
  • There is no nationwide legal requirement to fence private pools. Child-safety organisations themselves cite the lack of such a regime as a reason for proposed legislation. That does not relieve the owner; it can make the proof of reasonable precautions more difficult.
  • If the use changes, you have 14 days to notify an increased risk. Starting to rent can be such a change. Under Artigo 94.º of Decreto-Lei 72/2008, a claim can be reduced proportionally if the increased risk was not reported.

Who is liable for the pool under Portuguese law?

For a pool on private land, Portuguese law can place responsibility on the person who has the property under their control and a duty to supervise it, with a reversed burden of proof. This comes from Artigo 493.º n.º 1 of the Código Civil. The original text states:

Quem tiver em seu poder coisa móvel ou imóvel, com o dever de a vigiar […] responde pelos danos que a coisa […] causarem, salvo se provar que nenhuma culpa houve da sua parte ou que os danos se teriam igualmente produzido ainda que não houvesse culpa sua.

The critical words are salvo se provar. After an accident, the owner is not in the comfortable position of simply waiting for the claimant to prove every omission. The owner may need to demonstrate that reasonable care was taken. The injured person still has to prove damage and causation, but the fault question becomes more demanding for the person responsible for the property.

This explains much of what follows. It is why evidence of safety measures matters, why the absence of a legal fencing rule does not automatically help the owner, and why documentation is so important.

When another rule applies

Not every pool loss falls under Artigo 493.º. If a pool wall collapses or the structure gives way, Artigo 492.º can become relevant because it deals with collapse caused by construction or maintenance defects. Paragraph 2 can shift liability to a party contractually responsible for maintenance where the damage results exclusively from deficient maintenance. A written maintenance contract with a pool company can therefore matter for liability as well as service quality.

A pure omission gives rise to liability under Artigo 486.º only where there was a legal or contractual duty to act. That matters because Portugal currently has no general nationwide private-pool safety code, discussed below.

For limitation, Artigo 498.º n.º 1 provides a three-year period from the time the injured person becomes aware of the right to compensation, subject to the wider statutory framework and longer criminal limitation periods where applicable.

What many expat owners expect

One liability section covers everything around the home

  • “Personal liability” sounds as though it should automatically include accidents at the property’s pool.
  • A built-in pool looks like part of the house, so owners often assume it is automatically declared and insured.
  • Occasional holiday letting can feel like an extension of private use rather than a different commercial risk.
  • If no national fencing law exists, owners may assume there is no safety-related liability issue.

  • Liability arising from the insured property and liability from private life can sit under different sections.
  • Whether the pool itself belongs to the insured building can depend on how the policy defines or declares it.
  • Alojamento local has its own compulsory liability requirement with a statutory minimum.
  • The absence of a nationwide private-pool fencing rule does not remove the owner’s duty to take reasonable precautions.

Private use or rental: the distinction that changes everything

Whether the pool is used privately or is rented out for payment decides which insurance contract is potentially relevant. The line is not simply between “frequent” and “occasional” use, but between non-commercial use and activity with a commercial or profit-making character.

Both policy wordings reviewed draw broadly the same boundary. One excludes damage arising from professional or profit-making activity and from professional, commercial or industrial activity at the risk address. The other excludes situations arising from industrial, commercial or professional activity exercised at the property and, in the family-liability section, professional, mercantile, industrial, school or political activity.

Own use private

You, your family and guests who pay nothing. This is the area private liability sections are designed for, provided the right section is actually included.

Friends and family private

Free use is not a profit-making activity. One cited policy even expressly covers damage caused by children under 16 in your care where that care is unpaid.

Long-term tenancy check

An ordinary tenancy over months or years is not alojamento local, but it changes who occupies and supervises the property. The contract and insurance need to reflect the actual roles.

Alojamento local separate policy

Registered short-term accommodation. The law requires its own liability insurance of at least €75,000 per claim. Ordinary private-liability sections are not designed for this activity.

The right conclusion is therefore a policy review rather than a blanket answer. For private use, the starting point is Personal Liability Insurance in Portugal. For registered short-term letting, a commercial or dedicated accommodation policy is needed.

The grey area that only becomes clear when challenged

Between “friends stay for free” and registered alojamento local lies a grey area: friends contributing to expenses, platform rentals without registration, or occasional weeks let through an agent. These situations are not harmless because they can also trigger the risk-increase notification duty discussed later. Clarify the arrangement before the first guest arrives.

How home insurance treats the pool

Portuguese home-insurance products can treat pools very differently from the outset. For this guide, we reviewed the publicly available general terms of Fidelidade Casa Mais and Generali Multirrisco Casa as examples of market practice, not recommendations.

Fidelidade: the pool is part of the building

In the Fidelidade wording, tanks and swimming pools are expressly included in the building definition, together with permanently constructed fixed covers. A wall or fence added later may need to be expressly indicated and valued in the contract to count as insured property.

Generali: the pool counts only if it appears in the proposal

In the Generali wording, pools and tennis courts form part of the insured property only where they are provided for in the insurance proposal and are built using materials and methods comparable with the insured building. If the pool was not declared in the proposal, it may not be part of the insured object even if it is permanently built.

You cannot tell from looking at the pool whether it is in the policy. In one reviewed product it belongs automatically to the building; in the other only if it was declared in the insurance proposal.

Why a pool accident may not fall under personal liability

In the Fidelidade wording, the private-life liability section expressly excludes damage caused by a building owned by an insured person and damage caused by insured property. Because the pool belongs to the building definition there, the ordinary family-liability section may not be the right cover for a pool accident.

Two exclusions that can create the gap

One exclusion concerns “Danos causados por edifício ou fração de edifício […] de qualquer das Pessoas Seguras, ainda que seguros pelo presente contrato”.

Another concerns “Danos causados pelos bens seguros”.

In plain English: damage caused by the insured person’s building or insured property is directed away from the family-liability section and towards the specific liability cover for insured property.

At Generali the structure is different but leads to the same practical message: there is a specific Responsabilidade Civil Piscinas section, and if you have not bought it, it is not there.

Generali’s pool section and its four specific exclusions

Trabalhos de modificação Works

Damage arising from alterations or repairs to the pool is excluded. During works, the contractor’s liability insurance becomes important.

Tratamento da água Water treatment

Damage caused by inadequate cleaning or water treatment is excluded. This matters especially where a holiday-home owner relies on a third-party pool service.

Own household not a third party

Injury suffered by the insured or members of the household is excluded. Liability insurance protects against claims by third parties, not the insured’s own family.

Piscinas não permanentes temporary pools

Non-permanent pools are excluded. A frame pool installed only for the summer can therefore sit outside the specific pool-liability section.

For remote owners, the water-treatment exclusion is particularly important. If a contractor is responsible for pool maintenance, obtain evidence of the contractor’s own liability insurance and keep a written maintenance agreement.

Alojamento local: compulsory liability insurance

If a property with a pool is rented as registered alojamento local, Portuguese law requires a separate liability policy with at least €75,000 of cover per claim. The basis is Artigo 13.º-A of Decreto-Lei 128/2014 as amended by Decreto-Lei 76/2024 of 23 October 2024.

For a property with a pool, €75,000 is a statutory floor, not a risk-based recommendation. Serious injury can exceed it quickly. We therefore treat the limit as the starting point rather than the target.

Fence, cover and alarm: what Portugal requires

Portugal currently has no nationwide rule requiring a private swimming pool to have a fence, cover or alarm. That is reflected in the statements of organisations campaigning for a new safety regime. APSI, together with DECO and the industry association APP, describes its proposal as creating a regulatory framework that is currently missing, while DECO also refers to a legal gap for leisure pools in condominiums, local accommodation and private properties.

The existing public-sports-facility regime also excludes leisure facilities integrated into permanent residential buildings and intended for the private use of residents. Public-water-leisure rules therefore do not simply transfer to a private villa pool.

Why the absence of a rule can make the owner’s position harder

A missing statutory checklist does not mean “no duty”. Under the burden-of-proof structure discussed above, the owner may still have to show that reasonable precautions were taken. With no written national standard, the question becomes what was reasonable in the circumstances, and that is often assessed only after an accident has happened.

What can support the proof of reasonable precautions

What matters is not one single device but evidence that precautions were considered and maintained: a fixed fence with self-closing gate and child-resistant latch, a load-bearing safety cover rather than a simple thermal sheet, an alarm, slip-resistant paving, rescue equipment within reach, visible depth marking, a locked chemical cabinet, dated photographs and installation invoices.

For rental properties, add written pool-use rules and child-supervision guidance in the guests’ language and make them part of the check-in process.

Planning rules: exempt does not mean unregulated

Portuguese planning law expressly mentions swimming pools and can subject them to a prior-notification procedure, comunicação prévia. Statements online that “a pool in Portugal does not need permission” therefore tell only part of the story.

In the Regime Jurídico da Urbanização e Edificação, one provision expressly lists the construction of pools associated with a principal building under works subject to comunicação prévia, while another provision treats certain leisure equipment as works of minor urban relevance. Which provision controls a particular pool is a planning-law question for the relevant Câmara Municipal.

This connects directly to insurance because the reviewed policies contain exclusions relating to illegal or non-compliant construction and to poor maintenance. If you bought a house with an existing pool, it is worth checking the previous owner’s documents and asking the municipality what rules applied.

The neighbour: water, chemicals and lower ground

Liability towards a neighbour can arise even where the installation was properly authorised. Artigo 1347.º of the Código Civil addresses harmful installations and hazardous or corrosive substances near neighbouring property.

É devida, em qualquer dos casos, indemnização pelo prejuízo sofrido.

The clearest pool-related example is chemical storage: chlorine, pH reducer and treatment chemicals kept close to the boundary. If substances escape and damage neighbouring property, formal compliance with the garden building itself does not necessarily remove the compensation issue.

The slope makes the problem bigger

Many Algarve properties sit on slopes, often above the neighbouring plot. A leak from the pool shell, pipework or backwash can therefore move tens of tonnes of water downhill. This is exactly the sort of third-party property damage for which the building/property-liability section matters.

Pool service, cleaner, gardener: who counts as a third party?

For people working at the property, the reviewed wording creates an important distinction: damage they cause to third parties may be covered under the relevant liability section, while injury they suffer themselves can fall outside it because employment-related accidents require a different insurance solution.

Domestic worker damages a third party often covered

Where the relevant section is included, both reviewed products can cover acts of domestic employees while they are carrying out their duties.

Domestic worker is injured different insurance

Employment-related injury to the worker is excluded from ordinary liability and may require workers’ accident insurance.

Contracted company their policy

A professional pool company should carry its own business liability insurance, and a written maintenance agreement can also matter under the Civil Code where damage results from maintenance failure.

The difference between neighbourly help and employment

Paying someone regularly to maintain the pool without a contract or insurance can create the worst combination: no company’s business liability, no clear employment insurance and uncertainty over legal status. Regular paid work at the property should be formalised rather than left ambiguous.

Remote ownership: the 90-day definition and 14-day notification duty

A property occupied only for part of the year may be classified differently from a permanent residence. In one cited policy, residência não permanente is defined by reference to occupation for fewer than 90 days in the calendar year. The exact classification affects the contract as a whole.

What happens if the use changes

A change in use can amount to an increase in risk and should be reported within 14 days. The legal consequence is set out in Artigo 94.º of Decreto-Lei 72/2008: where an unreported increase in risk influences the occurrence or consequences of the claim, payment can be reduced in the proportion between the premium actually charged and the premium that should have applied to the real circumstances.

Example: what an unreported rental can cost

A holiday home with a pool is insured for an annual premium of €480. The owner starts renting it without notifying the insurer. The premium for the rented use would have been €800. A guest suffers an accident and the loss is valued at €60,000.

The premium ratio is 480/800 = 60%. A proportional payment could therefore be €36,000, leaving €24,000 for the owner. And this assumes the policy section is otherwise engaged; an exclusion for commercial activity may create a separate problem. The figures are illustrative, not actual quoted premiums.

What remains excluded even with a well-built policy

Your own family not a third party

Liability sections generally do not cover injury suffered by the insured or members of their household. Personal accident or health insurance addresses a different risk.

Property in your custody excluded

Both reviewed wordings exclude damage to property entrusted to the insured person’s care. A guest’s camera handed to you for safekeeping can therefore be a different question from ordinary third-party property damage.

Fines excluded

Liability insurance pays compensation, not regulatory or criminal fines.

Obvious lack of maintenance excluded

One reviewed policy expressly excludes manifest and proven lack of maintenance of property owned by the insured. Maintenance records are therefore part of the evidence supporting cover.

Six costly mistakes around a pool

What may change

A proposal to create a regulatory framework for private-pool safety has been promoted by APSI, DECO and the industry association APP, but our review found no enacted national regime as of August 2026. If legislation is eventually introduced, it may make the safety benchmark clearer for owners.

Separately, Portuguese planning law was being revised in 2026, but the rule expressly identifying pools under comunicação prévia remained in place in the text reviewed for this guide. Current municipal requirements should therefore always be checked at the Câmara Municipal.

Frequently asked questions

Do I have to fence my pool in Portugal?

There is currently no nationwide statutory fencing requirement for private swimming pools in Portugal. That does not mean there is no liability risk. Under Artigo 493.º n.º 1 of the Código Civil, the person responsible for the property may need to show that reasonable precautions were taken. Municipal requirements can also apply, so check with your Câmara Municipal.

Does personal liability cover an accident at my own pool?

It depends on the policy and is often more complicated than expected. In the Fidelidade wording reviewed, family liability excludes damage caused by the insured building/property and the pool forms part of the building. A separate liability section for insured property is then relevant. Generali offers a separate pool-liability special condition. Both need to be checked in the actual policy.

What changes if I rent out the house with the pool?

For registered short-term accommodation, Artigo 13.º-A of Decreto-Lei 128/2014 requires separate liability insurance with at least €75,000 per claim for damage to guests and third parties. Private-liability sections commonly exclude commercial activity, so rental should be treated as a separate insurance risk.

Is the €75,000 statutory minimum enough?

It is only a legal minimum. Amounts above the policy limit remain with the operator personally, and serious bodily injury can exceed €75,000 quickly. The appropriate limit should therefore reflect the actual exposure rather than only the statutory floor.

Who is liable if the pool service makes a mistake?

A contracted company should have its own business liability insurance, and Artigo 492.º n.º 2 can become relevant where a party is contractually responsible for maintenance. Your own policy must also be checked because one reviewed pool section excludes damage caused by inadequate cleaning or water treatment.

Do I need planning permission for a pool?

Often not a traditional building licence, but Portuguese planning law expressly lists swimming pools associated with a principal building under comunicação prévia. Other provisions may classify certain leisure works as minor urban works. Which rule applies to your pool should be confirmed with the local Câmara Municipal.

Is an above-ground pool insured?

In the Generali pool-liability section reviewed, non-permanent pools are expressly excluded. The Fidelidade building definition is less explicit on temporary pools. Confirm the position before the season rather than assuming a smaller pool means a smaller insurance issue.

How long can someone bring a claim after a pool accident?

Under Artigo 498.º n.º 1 of the Código Civil, the compensation claim generally has a three-year period from when the injured person became aware of the right, subject to the broader statutory rules and longer criminal periods where applicable. Keep maintenance records and evidence for several years.
